[Blog] European Unitary Patent and Opt-Out Strategy

Are you formulating an international patent strategy that involves the European market? The European Unified Patent will finally be launched on June 1, 2023!

After many years of efforts, a project for a single patent with unitary effect across the entire European Union (EU) has become a reality, and all participating countries will fall under the jurisdiction of a single international court known as the Unified Patent Court (UPC). From the day the UPC begins operations, European patent holders will be able to apply for unitary effect, allowing them to receive protection for their intellectual property rights in all participating countries. Conversely, a significant drawback is that limitations, transfers, cancellations, and waivers of rights will apply to all UPC member countries. However, European patent owners and applicants are allowed to opt out of the UPC's exclusive jurisdiction during a transitional period (initially 7 years, extendable up to 14 years). This option to opt out of UPC jurisdiction is known as "opt-out" and remains valid throughout the duration of the European patent. If one does not opt out, there is a risk that a single lawsuit in the UPC could lead to the cancellation of the European patent, making the opt-out application a defensive strategy in that regard. *For more details, please download the PDF or refer to the related links.*

[Blog] Cleaning the World's Oceans - By Patent

Focusing on inventions that contribute to the sustainability of aquatic ecosystems and the intellectual property rights that protect their research and development!

Every year, millions of tons of plastic flow into rivers and oceans, threatening wildlife and polluting water sources. Because plastic does not decompose naturally, this problem only worsens over time. Unless plastic is removed from water around the world, these pollutants will remain for centuries and continue to cause harm. Fortunately, innovative thinkers around the globe are developing ways to address this issue. Improving the water quality of oceans and rivers, as well as maintaining the water quality of less polluted areas, is key to long-term environmental and social health. Let’s focus on inventions that contribute to the sustainability of aquatic ecosystems and the intellectual property rights that protect their research and development. *For more details about the blog, please refer to the related links. [Blog] Considerations on Creative Commons and Image Licenses

"Basic knowledge of licenses" and "Checklist for image licenses" are included!

Using unlicensed images in personal blog posts that are not for commercial purposes may not seem like the end of the world. However, using them for product packaging, corporate websites, or marketing materials is a completely different issue. If the use is discovered, it won't take long before a cease-and-desist letter arrives from the copyright holder. Using copyrighted images without the proper license is one of the most common forms of intellectual property (IP) infringement, and its impact can escalate quickly. However, a little knowledge can be a powerful tool. By understanding copyright standards and following simple steps for image procurement and licensing, you can avoid this issue. *For more details about the blog, please refer to the related links. Regarding the registration agent for maintaining trademark rights renewal.

Typically valid for 10 years! It is necessary to renew the trademark rights to maintain their legal validity.

Trademark registration is typically valid for 10 years, so it is necessary to renew the trademark rights before the expiration of that period to maintain legal validity. To maintain trademark rights, it is necessary to submit a renewal application to the relevant patent offices (TMO), which is done through local agents designated and managed by our trademark renewal department. Additionally, when maintaining trademarks through local agents, there are registration agent rules such as "no need for agent change" and "optional." 【Registration Agent Rules】 ■ No need for agent change ■ Optional ■ Temporary agent change required ■ Mandatory agent change required *For more details, please refer to the PDF document or feel free to contact us.

[Blog] Trade Secret or Patent: Playing the Right Card

What is the difference between trade secrets/business secrets and patents? Is the protection of patents stronger than that of trade secrets?

When deciding how to protect newly developed technology, it is necessary to consider many factors, from the potential for licensing the invention to the pace of development and the level of competition within the industry. Before choosing either option to protect intellectual property, it is essential to fully understand the relative advantages and disadvantages of trade secrets and patents. A trade secret refers to confidential information about a product, service, or commercial process that is known only to a limited number of people. In contrast, a patent is a legal right that excludes others from using a certain invention, such as a machine, manufactured product, technical method, or industrial process, for a specific period. You must choose whether to obtain a patent and disclose the technology to gain legal rights that exclude others from using the invention for a certain period, or to keep the components, ingredients, or design of the product confidential. *For more details, please refer to the full text via the related link.*

[Blog] A Heartbreaking Story: The Cost of a Failed Rebrand

A melting pot woven from materials! Introducing examples where the judgment on rebranding was too lenient or mishandled.

Why do some people stand in line for days to get the latest model of a mobile phone or neon-colored sneakers? Is it the product quality, advertising effectiveness, the need to convey a specific image, or pure loyalty? Yes, it’s all of those and more. Because the intellectual property (IP) that supports all brands moves our emotions as strongly as sales do. Customers seek brands that offer unique and reliable solutions, ones that reflect their desires and speak to them on a personal level. When branding is done well, it can enhance a company's market value and transform its customer base into a fan base. *For more details about the blog, please refer to the related links. [Blog] Intellectual Property Takes Flight: Inventing the Future of Aviation

We have the legal knowledge and advanced tools to protect your patent worldwide!

As advancements in aviation technology are often overlooked, the impact on environmental issues tends to be underestimated as well. However, fortunately, the technological victories achieved since the dawn of powered flight are set to be realized through many sustainable developments in the coming years. The European Union (EU) has set an ambitious goal of becoming completely carbon neutral by 2050. However, to offset the gigatons of carbon dioxide emitted by airlines in 2019, concrete and immediate solutions are needed. In the forefront of such research and development, intellectual property rights (IP) are key to innovation and protect the inventions that will change our skies. *For more details on the blog, please refer to the related links. [Blog] What Does "Patent Pending" Mean (Can It Protect an Invention)?

Does being in the application process lead to patent protection? Published 'From Application to Grant'!

The process from patent application to acquisition can take years, even if it is swift. During this time, it is natural for inventors and organizations to seek ways to prevent unauthorized reproduction of their creative activities and to build a foundation for when their "ongoing" intellectual property rights come to fruition. The term "patent pending" should be familiar to people in English-speaking cultures, but its precise meaning is often ambiguous. To make the most of the intellectual property framework and avoid pitfalls, it is important to understand when, how, and where these terms are positioned within the patent application process. *For more details about the blog, you can view it through the related links.
